7.3  Service credits

If Monthly Availability falls below the commitment in Section 7.1 (99.9%), Customer is entitled to a credit against the quarterly fees then due, per the schedule below. Credits are calculated on quarterly fees: 10% where Monthly Availability is below 99.9%, and 25% where Monthly Availability is below 99.5%. Credits are Customer's sole remedy for availability shortfalls and must be requested within 30 days.
